Applies to: the Fyltec mobile and desktop apps, the Fyltec parental-control service, and fyltec.com (together, the “Service”).

These Terms of Service (“Terms”) are a binding agreement between you and Fyltec (Pty) Ltd, 18 Gleian Road, Sandton, Gauteng, South Africa, 2191 (“Fyltec”, “we”, “us”). By creating an account, pairing a device, or using the Service, you agree to these Terms and to our Privacy Policy (https://fyltec.com/privacy-policy/). If you do not agree, do not use the Service.

1. Eligibility and authority

  • You must be at least 18 years old and able to form a binding contract.
  • You may use the Service only as a parent or legal guardian of the child whose device you manage, or to manage your own device(s).
  • You represent and warrant that you have the legal right and authority to install the Service on, and to monitor and control, each device you pair, and to consent to the data processing described in the Privacy Policy on behalf of your household.
  • You are responsible for complying with all laws that apply to monitoring a minor or any device in your jurisdiction.

2. The Service

Fyltec provides parental-control tools that a parent configures, which may include: DNS-based content filtering and blocklist management; app blocking and screen-time scheduling; activity monitoring and reports; real-time location and geofencing; remote device lock; tamper-protection alerts; and account, pairing, and notification features. Features available to you depend on your subscription plan and on the device platform.

We may add, change, or remove features. We will not make material reductions to a paid feature you are actively relying on without reasonable notice where practicable.

3. Accounts and security

  • Only parents/guardians create accounts. Child devices are added by pairing, not by independent child sign-up.
  • You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
  • We may offer two-factor authentication; you are responsible for maintaining access to your authentication method.
  • Notify us promptly of any unauthorized use of your account.

4. Pairing child devices and lawful use

  • A device becomes managed only after you pair it using a parent-held code or invite and accept these Terms and the Privacy Policy. This constitutes your consent, as parent or guardian, to the monitoring and data processing for that device.
  • You agree to use the Service only for lawful parental control of your own household.
  • You agree not to use the Service to monitor, track, or control any person without the lawful authority to do so including, without limitation, other adults, partners, or employees or for stalking, harassment, or any unlawful surveillance.
  • You are responsible for informing members of your household about monitoring to the extent required by law.

5. Acceptable use

You agree not to: use the Service for any unlawful purpose; interfere with or disrupt the Service or its security; attempt to gain unauthorized access to systems or data; reverse engineer, decompile, or circumvent technical protections except where such restriction is prohibited by law; resell or commercially exploit the Service without our written permission; or use the Service to violate the rights of others.

6. Subscriptions, billing, and renewals

  • Some features require a paid subscription. Plans, prices, included features, and any free-trial terms are shown in the app before you confirm a purchase.
  • In-app purchases are processed by the app store you downloaded Fyltec from the Apple App Store or Google Play and are subject to that store’s terms. Fyltec does not receive or store your card details for these purchases. (If, in future, Fyltec offers a subscription purchased directly on fyltec.com, that purchase will be handled by our payment processor and governed by the terms shown at checkout.)
  • Auto-renewal: Subscriptions purchased through an app store renew automatically for the same period at the then-current price until you cancel. You manage or cancel renewal in your Apple App Store or Google Play account settings; cancelling stops future renewals.
  • Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends, in line with the rules of your app store.
  • Prices may change; we will give notice as required by law and by your app store before a changed price applies.
  • You are responsible for applicable taxes, which your app store may collect on our behalf.

7. Cancellation and refunds

  • You may cancel at any time through your Apple App Store or Google Play account settings. Cancellation stops future renewals and takes effect at the end of the current billing period; access to paid features continues until then.
  • Refunds for app-store purchases are handled by Apple or Google under their own refund policies, not by Fyltec, and refund requests must be directed to the relevant app store. Where you purchase directly from Fyltec in future, refunds will follow the terms shown at checkout and applicable law.

8. Safety notice and service limitations

The Service is a tool to assist parents; it is not a substitute for parental supervision and does not guarantee a child’s safety.

  • Filtering is not perfect. No content filter blocks all harmful content or allows all legitimate content. New sites, apps, and workarounds appear constantly, and some content may be miscategorized.
  • Tamper protection can be circumvented. A determined user may find ways to disable or bypass controls. Alerts are best-effort and may be delayed or missed.
  • Location is approximate. Location and geofence features depend on device hardware, connectivity, permissions, and operating-system limits, and may be delayed, inaccurate, or unavailable.
  • Device lock and emergency calling. Where the Service offers a locked-device emergency-call option, it is provided for convenience only and is not guaranteed; it is not an emergency response service. Always use your normal emergency services. You are responsible for ensuring a managed device can reach emergency help.
  • Availability. The Service may be unavailable or interrupted due to maintenance, network conditions, app-store or platform changes, or events beyond our control. It is provided on an “as available” basis.

You acknowledge these limitations and agree not to rely on the Service as your sole means of protecting or locating a child.

9. Network filtering / VPN consent

To filter content, the Service routes the device’s DNS lookups through an on-device VPN/DNS proxy and our filtering service. By enabling filtering you consent to this routing. We handle data from this connection only as described in the Privacy Policy (https://fyltec.com/privacy-policy/) and do not sell it or disclose it to third parties for their own purposes.

10. Third-party services

The Service relies on third-party providers (for example, push-notification, mapping, payment, and DNS providers). Your use of those features may be subject to the third party’s terms, and we are not responsible for third-party services we do not control.

11. Your data

Our handling of personal information is described in the Privacy Policy (https://fyltec.com/privacy-policy/), which forms part of these Terms. You are responsible for the accuracy of information you provide and for exercising the data rights and controls (including disabling features, unpairing devices, and requesting deletion) available to you.

12. Intellectual property and licence

The Service, including its software, design, and content, is owned by Fyltec or its licensors and is protected by law. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your household’s parental-control purposes. All rights not expressly granted are reserved. “Fyltec” and our logos are our trademarks and may not be used without permission.

13. Disclaimers

Except as expressly stated and to the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will block all unwanted content or detect all activity. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you, and you may have statutory rights that these Terms do not override.

14. Limitation of liability

To the maximum extent permitted by law, Fyltec and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any harm arising from content that was not blocked, activity that was not detected, or a location that was inaccurate or unavailable. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, fraud, or your non-excludable consumer rights).

15. Indemnification

You agree to indemnify and hold Fyltec harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your use of the Service to monitor or control any person or device without lawful authority.

16. Suspension and termination

We may suspend or terminate your access if you breach these Terms, if required to protect the Service or other users, or if required by law. You may stop using the Service and close your account at any time. On termination, your licence ends and we will handle your data as described in the Privacy Policy. Sections that by their nature should survive (including ownership, disclaimers, liability limits, and indemnity) survive termination.

17. Changes to these Terms

We may update these Terms. Material changes will be notified in-app or by email, and the “Effective date” above will be revised. Continued use after an update means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of South Africa, without regard to conflict-of-laws rules. The courts of South Africa will have jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.

19. App Store terms (Apple and Google)

If you obtained the app from the Apple App Store or Google Play, the following also apply:

  • These Terms are between you and Fyltec only, not with Apple or Google, who are not responsible for the app or its content.
  • Apple and Google have no obligation to provide maintenance or support for the app; that responsibility is ours.
  • To the extent permitted by law, the app-store provider has no warranty obligation, and any claims relating to the app are our responsibility, not theirs.
  • The app-store provider is not responsible for addressing claims that the app or your use of it infringes intellectual-property rights.
  • You represent that you are not located in a country subject to a relevant embargo and are not on a prohibited-parties list, and you will comply with applicable export laws.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You must comply with the applicable app-store terms of service.

20. General

These Terms and the Privacy Policy are the entire agreement between you and Fyltec regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
